Divorce
Family Law matters fall under the Commonwealth jurisdiction and all
cases are dealt with through either the Federal Circuit Court or the
Family Court of Australia depending on complexity. If you are married,
you will need to be separated for 12 months before you are permitted to
apply for a Divorce.
If you have children of the marriage
who are under 18 years of age, the Court will need to be satisfied that
proper arrangements in all the circumstances have been made for the
care, welfare and development of those children.
You do not have to be divorced to settle your financial and property affairs on a final basis. However, once you are divorced parties only have 12 months to initiate a property settlement.
Keep in mind, you are not free to re-marry until your Divorce Order is granted.

Fixed Fee Divorce
Michelle offers Fixed Fees to assist you in obtaining a Divorce Order so you can move on with your life. If you have been married for at least 2 years, separated for at least 12 months, agreed on your parenting matters and you are both ready to get divorced - then you are eligible to make a joint application to the Courts for a Divorce Order. If your partner is not ready, but you are - then you may be eligible to make a single application to the Courts for a Divorce Order.
